Since June 2025 the accessibility of your website has been mandatory, and almost nobody knows it.

Ley 11/2023 transposes the European accessibility directive and has applied to the private sector since 28 June 2025. It covers services contracted over the internet, and booking an appointment online is one of them. Penalties reach 30,000 EUR for minor infringements, 90,000 EUR for serious ones and 1,000,000 EUR for very serious ones, and the body that polices it is not Madrid: it is the autonomous communities, each with its own authority.

In August 2026 we audited 1,987 Spanish private clinic websites with Google Lighthouse, which is free and public. Of the 1,861 that returned a result, 95.5% fail at least one criterion. Among hospitals and hospital groups, which cannot claim the microenterprise exemption, it is 122 out of 125. Only 10.1% publish an accessibility statement, which the law requires.

Does this apply to me?

If your clinic has 10 employees or more, or turns over more than 2 million euros, yes. Service microenterprises below both of those thresholds are exempt under article 3 of Ley 11/2023. In the free audit we tell you which of the two cases you are in before you hire anything.

How big are the fines?

The law grades infringements as minor, serious and very serious, with ceilings of 30,000 EUR, 90,000 EUR and 1,000,000 EUR respectively. The body that inspects and fines is the market surveillance authority of your autonomous community, not a national one.

Since when has it been in force?

Since 28 June 2025 for services aimed at consumers, which is where online appointment booking sits. It has been applying for over a year.

What exactly fails on a clinic website?

In what we measured, almost always the same things: insufficient colour contrast (79.5%), links and buttons with no accessible name (65.2%), headings out of order (48.8%) and zoom disabled on mobile (24.3%), which stops a person with low vision enlarging the page to book an appointment.

Does the whole website have to be rebuilt?

Almost never. Most of the failures are fixed on the website you already have. If the website is so old that it cannot be fixed, we tell you and we look at rebuilding it, but that is not the usual case.

How do I prove that I comply?

With the accessibility statement published and with the dated audit report, with the score before and after and the criteria fixed. That is what you can show if somebody asks.

What about cookies and GDPR?

They sit apart from accessibility and we review them anyway. The Spanish Data Protection Agency fines badly implemented cookie notices, and in healthcare the data being handled is health data, with a higher standard.

Where do your figures come from?

From our own study: in August 2026 we audited 1,987 Spanish private clinic websites with Google PageSpeed Insights, which uses Lighthouse and is free and public. 1,861 returned a result. You can reproduce any of the numbers by putting a URL into that tool.
